Native Townships Bill. I have the honour to report that the Native Affairs Committee, to whom was referred the Native Townships Bill, have duly considered the same, and direct me to report that they are of opinion it should be allowed to proceed, subject to the amendments as shown on the copy attached hereto. 3rd July, 1895.

Nos. 453, -1894, 464, 1894, and 46, 1895.—Petitions of Eangihaeata and 69 Others; E. T. Eangihaukoei and 2 Others (No. 1); E. T. Eangihaukoei and 646 Others (No. 2). The petitioners complain that they have insufficient land for their occupation. Some of the confiscated land given to the tribe has been leased, but what they desire is some land they can occupy and cultivate. The matter is so important that the Committee think the Government should at once take steps to inquire into the state of the petitioners, and, if necessary, get powers to allocate some land for their occupation, should it be found that the land they now hold is insufficient for their support. 11th July, 1895.

No. 357, 1894.—Petition of Daniel James McEwen, Petitioner states that, through the operation of " The Native Equitable Owners Act, 1886," he is unable to complete the purchase of the Paparoa Block. He prays for relief. The Committee have to report that the title of the petitioner to the land he claims is not disclosed; but, assuming he is the lessee, he has been deprived of the right to purchase the land by the operation of "The Native Equitable Owners Act, 1886." The Committee cannot recommend that the petitioner has any claim on the colony. 11th July, 1895.

No. 463, 1894.—Petition of Paeanihi Tukoko and 4 Others. Petitionees pray that they may receive a grant of land in reward for military services rendered during the Waitara war of 1860. I have the honour to report that the Committee is of opinion this petition should be referred to the Government for consideration with other military claims. 11th July, 1895.

No. 638, 1894.—Petition of Members of the Eangitane Tribe. Petitionees pray for a grant of land in reward for military services. I have the honour to report as follows: The petitioners fought in the wars of 1866-68 on the West Coast. Some of the Native contingents who fought at the same time have had land awarded to them for their services. The petitioners did not send in their claim before the date fixed by the Naval and Military Settlers Act for receiving claims. They explain this neglect by stating that they expected Major Kemp, at whose request they fought, would have claimed the land for them. As the question of granting land for military services to Europeans will, it is understood, have to be considered by the Government, the Committee recommend that this petition be deemed a claim, and be dealt with by the Government when the other claims for military services are considered. 11th July, 1895.

Petitionees allege that the Maoris do not receive proper notices relating to the rating of their land, and that the rating-values are wrongly assessed. They pray that the Native race may be exempt from taxation. I have the honour to report that the Committee recommends that these petitions should be referred to the Government for the purpose of having the allegations as to insufficient rating-notices and wrong valuations fully inquired into; and they also recommend that all local bodies should be instructed to insure that Native owners are made fully aware of all matters relating to the rating of their properties. ! 26th July, 1895. —■

No. 366, 1894.—Petition of Hoterene Kawiti and 32 Others. Petitionees pray that they may still be allowed to use a certain road to the Kawakawa Estuary which was closed when the railway-station was removed. I have the honour to report that, as the road referred to has been used for years both by Natives and Europeans, and, as the Natives received a distinct promise that the road should remain open, the Committee recommends that the Government should grant the prayer of the petition. 30th July, 1895.

No. 4.—Petition of H. T. Mahupuku. Petitionee states that he is the owner of land valued at about £18,000, and has other rights in land worth some thousands more. He wishes for authority to borrow on the security of his land to pay his debts. Under the Act of last session, and by the policy of the Government indorsed by the House, he can neither sell his land nor borrow. If he were allowed to borrow or sell he would have enough left, he says, to maintain himself and his family. He is threatened with bankruptcy if he can get no relief by some alteration of the law. The Committee recommend the petition to the careful and serious consideration of the Government, believing that cases of this kind should be dealt with in the amending Bill about to be brought before Parliament. 31st July, 1895.

Petitionee prays that legislation may be passed to relieve him and other Native owners of land from the disabilities caused through the passing of "The Westland and Nelson Native Eeserves Act, 1887," and that he may be reimbursed the expenses and losses incurred through the same cause. Petitionees allege that the sale of the Kakiraawa Block No. 5 was irregular, and that they are left with insufficient land for their support. They pray for investigation and relief. No. 236.—Petition of Te Mica and 15 Others. Petitionees allege that a reserve originally laid down for them in the Waipuku, Patea Block, the land on which the Town of Stratford now stands, was taken by Government, and one of much less value given to them instead. No. 234—Petition of Enoka te Taitu and 31 Others. Petitioners complain that the Native owners of the reserves of " tenths " in Wellington are unable to obtain moneys due on the same. They pray for relief. I have the honour to report that the Committee indorses the recommendation made on a similar petition in 1893, namely : that the matter should be inquired into and adjusted by a Judge of the Native Land Court; and they are of opinion that immediate steps should be taken by the Government to have that recommendation carried into effect. 18th September, 1895.

No. 322.—Petition of Te Eanui Omahubu and 212 Others. Petitionees pray that their interests in the West Coast Settlement Eeserves may be individualised, to give them an opportunity of working their own lands. I have the honour to report that the Committee recommend that the Public Trustee should, with the utmost publicity, invite applications from the Native owners who wish to occupy and cultivate their individual shares of the land, and, on receipt of such applications, give each applicant the opportunity of benefiting by the individualisation of his property, instead of being compelled, as at present, to live in a state of communism. 18th September, 1895.

No. 107.—Petition of Apihai Tango and 107 Others. Petitionees complain that they have been injured by a certain decree of the Validation Court in regard to the Whangara Block. They pray that the matter may be inquired into and readjusted. I have the honour to report that, having heard the parties interested, the Committee are of opinion that none of the allegations of the petitioners have been substantiated, and they therefore have no recommendation to make, more especially as it was represented to the Committee that, if any slight error had been made in fixing the southern boundaries of the leasehold land, Mr. Seymour was quite willing to allow certain concessions to the Natives. No. 226.—Petition of Pieinihi te Eito and 5 Others. Petitionees allege that they forwarded an application for a rehearing in the Paraumu Block in proper form, but the same does not appear to have been received by the Native Land Court: they pray that the Court may now be empowered to grant a rehearing. I have the honour to report that, as the Chief Judge states that he sees no reason to doubt the accuracy of the statements in the petition, your Committee think that relief should be granted to the petitioners, and provision made in the present amending Native Land Bill for this and similar cases. No. 180. —Petition of Pieipi te Maari and 5 Others. Petitioners pray that their grievances in connection with the Wairarapa Lakes may be inquired into, and relief granted. Your Committee have to report that in 1893 the same question was considered by the Native Affairs Committee, and the following report was made to the House —namely, "That the whole question dealt within the petition was reported on by a Eoyal Commission in 1890. {Vide Vol. 11., Appendices, Sess. 11., 1891, G.-4.) It is clear that the Natives have been wronged, and the only question is whether the local bodies interested or the Government should compensate them. The Committee is of opinion that it should be done by the Government, as the land was sold to the settlers, and provision made in the Public Works Act which enabled the local body to open a channel from the lake to the sea, and thus the proprietary rights of the Natives were interfered with. The Committee recommend that the Government should at once try to arrange the matter, either by purchasing the rights of the Natives or by compensating them for any injury done." Your Committee regret that no attention has been paid to the recommendation of the Committee of 1893, and the Committee would again most urgently recommend that the undoubted grievances under which the Natives labour should be redressed. The Committee may add that it has been represented to them that the Government are seeking to make a claim against the lake for surveying not undertaken at the request of the Natives, and threaten to sell the rights of the lake for such survey. The Committee hope that it is not the intention of the Government to take such steps. Bth October, 1895.

No. 430.—Petition of William Henry Tucker (No. 2). Petitionee prays that he may be relieved from the litigation which is pending in regard to the Makauri, Taruheru, and Tahoka Blocks. I have the honour to report that, in the opinion of the Committee, the Court created under "The Poututu Jurisdiction Act, 1889," was meant to decide matters finally without appeal or rehearing, and, as doubts have been raised as to whether the statute carries out that intention, legislation should be passed this session making such intention clear. No. 195.—Petition of Ahueei Hikaibo and 5 Others. Petitioners pray that a rehearing may be granted in connection with Pirongia West No. 1. They allege that, through a breach of trust on the part of those appointed to hand in the lists to the Native Land Court, persons received shares in the block who were not entitled to them. I have the honour to report that the Committee are of opinion that the Chief Judge of the Native Land Court should hold an inquiry regarding the injustice which appears to have been done to the petitioners. 16th October, 1895.

Petitioner prays that he may be released from the responsibility of having to rehear cases on which he has already given judgment under " The Poututu Jurisdiction Act, 1889." I have the honour to report that your Committee, having considered this petition, are of opinion that it was intended that the findings and decisions of the Court established under " The Poututu Jurisdiction Act, 1889," should be final and conclusive, without appeal. As it has been stated on behalf of the Government that it is their intention to introduce legislation this session affirming that view, whilst at the same time the legal proceedings pending in the Supreme Court should not be affected nor legal rights created injured, the Committee think the prayer of the petitioner will be met by such legislation.
