NAVAL DEFENCE ACT, 1913. (REGULATIONS UNDER THE).

Financial and Allowance Regulations under the Provisions of the Naval Defence Act, 1913. LIVERPOOL, Governor. ORDER IN COUNCIL. At the Government House at Wellington, this twentieth day of August, 1914. Present : His Excellency the Governor in Council. TITTHEREAS by the Naval Defence Act, 1913, it is enacted that the VV Governor may, by Order in Council gazetted, make regulations prescribing all matters which are necessary or convenient to be prescribed for carrying out or giving efiect to that Act: Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him as aforesaid, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations with respect to the New Zealand Naval Forces, and declare that the same shall come into operation on and from the fifteenth day of July, one thousand nine hundred and fourteen.
PAY AND ALLOWANCES FOR OFFICERS (SEA-GOING). 1. (i.) The rates of pay and allowances for commissioned and subordinate officers lent from the Royal Navy shall be same as at present obtaining in the Royal Navy, except in so far as additional emoluments shown in 1 (ii) afiect it.

Additional Emoluments.—Allowances foe Uniform and Rations. 1. (ii.) In addition to '' active pay " and " deferred pay," each subordinate and commissioned officer shall receive— In cash-—ls. per diem, allowance towards cost of uniform ; Rations in kind, or allowance in lieu at Is. 4d. per diem; Medical attendance, valued at 3d. per diem. Subject to the approval of the Naval Authority, allowance towards cost of uniform, covering the period of first twelve months' service, may be paid in advance to subordinate and commissioned officers on first appointment. If serving in harbour ships or establishments, the allowance in lieu of rations will be Is 2d. per diem only. Special Allowances.—Commissioned and Subordinate Officers. 1. (iii.) (a.) Rates of pay for special duties for all commissioned and subordinate officers shall be the same as obtain in the Royal Navy. (b.) Lodging-allowance (for officers not provided with cabin accommodation or quarters on shore) : —

Additional Emoluments. — Allowance for Uniform, Rations, and Medical Attendance. 1. (v.) In-addition to " active pay " and " deferred pay," each warrant officer, commissioned warrant officer, and officer promoted from rank of commissioned warrant officer, shall receive— In cash—ls. per diem, allowance towards cost of uniform. Spkcial Allowances.—Warrant Officers, etc. 1. (vi.) The following allowances, in addition to " active pay," shall be paid to officers while employed (and only during such period) on the special duty or in the special circumstances mentioned :—
In the event of warrant officers' stoics being plaoed in charge of a commissioned officer (other than a commissioned warrant officer), allowances on the above scale may be paid, but these stores are not to be placed in charge of such officers when a competent commissioned warrant officer or warrant officer is available. The rules in regard to the payment of store allowances at the end of Appendix VII, King's Regulations and Admiralty Instructions, 1013, Vol. 11, are to govern the payment of the above allowances in the New Zealand Naval Forces, where applicable. PAY AND ALLOWANCES, PETTY OFFICERS AND MEN (SEA-GOING). 2. (i.)" The following rates of " active pay," " deferred pay," and allowances shall apply to petty officers, men, and boys entered for sea-going Naval service under the New Zealand Government on and after the 15th July, 1914. With the exception of Officers' Stewards, Officers' Cooks, and Ships' Musicians, all ratings will be required to execute engagements to serve for a first period of seven years from date of entry, or from the date of attaining eighteen years, if such date s subsequent to date of entry. Ratings may be allowed to re-engage for further per ods of seven years if recommended by the Commanding Officer of the ship or establishment in which they are serving and approved by the New Zealand Naval Authority. Ratings lent from the Active List of the Royal Navy will be required to engage for three years' service, which period may in special circumstances be extended. Officers' Stewards, Officers' Cooks, and Ships' Musicians will be required to engage or re-engage for three years' service. All previous service in Royal Navy or Royal Marines will be allowed to count for rates of pay, good-conduct badges, and other allowances as if served under the New Zealand Government.

Allowances for Uniform, Rations, and Medical Attendance. 2. (ii.) In addition to " active pay " and " deferred pay," each man and boy shall receive— Uniform—as prescribed in Regulation 2 (iii). Rations in kind, or allowance in lieu— Sea-going ships, Is. -Id. per diem. Harbour ships and establishments, Is. 2d. per diem. Medical attendance, valued at 3d. per diem. Clothing Gratuity and Allowance towards Cost of Uniform. 2. (iii.) Each man and boy on first joining the Permanent Naval Forces shall be credited with a clothing gratuity of £9 2s. 6d. in kind. After completion of fust twelve months' service an allowance towards cost of uniform at the rate of 6d. per day in kind shall be credited in arrear cm the last day of the quarter to each rating. Clothing gratuity or allowance towards cost of uniform shall not be paid to the individual man or boy, except as hereafter provided, but shall be used in payment of uniform clothing issued to each individual, the cost of which shall be charged against the gratuity or allowance. The kit to be maintained by each man or boy shall be that laid down in the Uniform Regulations. Any clothing required by a man or boy in addition to that paid for as above shall be provided at his own expense. In the case of a rating- discharged to shore within one year of first entry, the value of clothing issued under the gratuity in excess of an amount of 6d. per day for the actual period of his service shall be deducted from deferred pay due to him. If the deferred pay due is insufficient to cover this charge, the balance of the amount shall remain as a charge against the gratuity. On promotion to warrant rank, or on discharge from service, a rating shall be paid in rash, any balance standing to his credit in the clothing account. In lieu of clothing gratuity or allowance towards cost of uniform being credited to a rating, as prescribed in these regulations, the Naval Authority may approve in special cases of an allowance towards cost of uniform at the rate of 6d. per day being paid in cash. Recovered deserters are not to be treated as new entries, nor credited with a further clothing gratuity of £9 2s. 6d. The gratuity account is to stand in the ledger as at date of desertion, but the " date to which credited " is to be extended by the period of the deserter's absence. In extending the " date to which credited " the period of the deserter's absence is to be calculated in months, part of a month being considered as one month. The kit of a deserter, if not sold before his recovery, may be restored to him. If his kit has been sold, he should be supplied with a reduced kit (as laid down in the Uniform Regulations), to be charged against any credit on clothing gratuity account or against pay. In all cases where " deferred pay " is stopped for any period under the provisions of Regulation 3, the allowance towards cost of uniform of 6d. per day shall also be stopped for the same period, except that no stoppage of clothing-allowance is to be made during a rating's first twelve months' service. Petty Officers dressed as seamen shall, on promotion to Chief Petty Officers, be "paid a gratuity of £5 towards cost of change of uniform. Such sums shall-be credited in the ledger as " Uniform allowance paid in cash." A gratuity of £5 shall be paid to every Petty Officer or man dressed as a seaman on transfer to another rating, provided he is required to change his uniform from Class IT to Class lIT. A rating required to change his uniform from Class 111 to Class IT shall also be paid this gratuity. No gratuity shall be paid when the transfer is made on account of misconduct. Such sums shall be credited on the ledger as '' Uniform allowance paid in cash." Good-conduct Badges and Medals. 2. (iv.) Deferred Pay. 3. The following conditions shall govern " deferred pay " :— (a.) The account of each officer or man in receipt of deferred pay will be credited with the amount deferred and with the interest thereon ; the interest— (i.) To be allowed at the rate of 3J per cent; (ii.) To be added to each individual's account annually on 30th June ; (iii.) To be computed annually on the amount standing to credit of the individual at the end of the previous financia year. (b.) On resignation or retirement of any officer entitled to deferred pay, the actuarial equivalent of accumulated amount of his contributions will be granted to him; the individual concerned to have the option of receiving this actuarial equivalent— (i.) In the form of an annuity for life ; (ii.) Half in the form of an annuity and half in the form of a cash payment ; (iii.) In other form, if desired, in special circumstances, to be decided by the Naval Authority. (c.) On the discharge of any rating the actuarial equivalent of accumulated amount of his contributions will be granted to him as follows :— (i.)- Seven years' service or less, in the form of an annuity for life : (ii.) Over seven years' service and under fourteen years, if re-engaged for second period —As above, or half in the form of an annuity and half in the form of cash payment; (iii.) Over fourteen years' service, if re-engaged for third per od—Either of the above or, by permission of the Naval Authority, cash payment in full. (d.) In the case of death of an individual whilst in the service, the full amount of accumulated deferred pay will be payable to his estate. (c.) Persons dismissed from the Naval Service for misconduct (as defined in the Naval Regulations) will forfeit all claim to deferred pay : Provided, however, in the case of men, that deferred pay for each completed term of engagement or re-engagement shiiil not be subject to forfeiture. (_/.) Contributions by the Dominion towards pension rights of officers and men lent from Royal Navy shall be deducted from amounts credited to such officers and men on account of deferred pay, and in case of such officers and men the accumulated balance (if any) shall be payable to them as a cash payment on their return to the Royal Navy. (g.) Men entered or re-engaged shall not be entitled on discharge to draw deferred pay until the expiration of the period of time for which they engaged or re-engaged to serve :

Provided that in cases where ratings are discharged invalided or otherwise in the interests of the service before the expiration of the period for which they engaged or re-engaged to serve, the Naval Authority may, where it appears desirable, approve of payment of deferred pay being made to such rating on discharge. (A.) Deferred pay shall not be credited in any of the following circum stances :— (i.) During imprisonment or detention (either summarily or by Courtmartial) ; (ii.) Imprisonment after conviction by Civil power : (iii.) Confinement in cells ; (iv.) Sick-leave granted without paw In every case where active pay is drawn deferred pay shall he credited. Mulcts for leave-breaking or deductions <>n account of being in the 2nd Class for conduct and sick-leave granted <m reduced pay shall not affect deferred pay. (i.) Save in the case of men lent from the Royal Navy, deferred pay shall in no case be granted to any man until he has been enrolled in the Royal Naval Reserve on discharge as prescribed by the Regulations. VICTUALLING AND CLOTHING. 4. The system of victualling and clothing will for the present be the same as obtains in the Royal Navy. The prices to be charged are subject to variation, and will be such as shall be prescribed from time to time by the Naval Authority. STATIONERY ALLOWANCES. 5. Stationery allowances, subject to the conditions set out in Article 1369 of the King's Regulations, so far as applicable, may be paid as follows :— li r Ann urn. The Accountant Officer may pay himself, on commissioning, twelve months' advance of the stationery allowance, and afterwards, at the commencement of each quarter, a quarter's allowance, at the rates laid down in this regulation. The Accountant Officer shall provide from this allowance the stationery required in the performance of the public duties of the Captain and of the heads of departments of the ship, for binding the ship's books, and also for any supplies that may be necessary for tenders. On- being superseded he is to hand over to his successor the proper proportion of the advance in respect of the unexpired period, or articles in kind equivalent in value thereto ; the succeeding Accountant Officer, on the other hand, is to reimburse his predecessor for whatever necessary outlays on the above heads be has made which are not covered by the allowance already drawn. In every ship not supplied with stationery in kind, in which a Naval Schoolmaster is borne or a competent person detailed to perform the duties of Schoolmaster, expenditure within the following limits may be approved by the Commanding Officer for the purpose of supplying slates, paper, and school necessaries for the use of the men and boys attending the school, and for supplying the requirements of the Schoolmaster :— Ships with complements exceeding 600—£4 on commissioning, and £1 for each subsequent quarter ; Ships with complements, 201 to 600—£3 on commissioning, and 15s. for each subsequent quarter ; Ships with complements not exceeding 200—£2 on commissioning, and 10s. for each subsequent quarter.

These amounts are not to be paid as an allowance, but all expenditure shall be subject to the production of supporting vouchers. Payment should lie made to the Chaplain, or, if no Chaplain is borne, to the officer superintending the school-work. DESERTERS. (i. A person who deserts Iroin the Naval Service shall forfeit all active pay, allowances, and deferred pay due to him to the date of desertion, and shall forfeit all past service for the purposes of furlough, of good-conduct badges, and long-service and good-conduct medal. The Naval Authority may in the case of recovered deserters in special circumstances approve of the restoration of any portion of the pay, allowances, deferred pay, or service forfeited by the act of desertion. The Captain is to cause the clothes and effects of a deserter to be delivered into the charge of the Accountant Officer, together with an inven tory signed by two or more persons. After the expiration of three months from the date of desertion the Captain shall authorize the clothes and effects of a deserter to be sold on board by auction. Rewards for arrest of deserters shall be paid as follow : — Up to a limit of £1 for a straggler. Up to a limit of £5 for a deserter or presumed deserter. The amount of the reward, within above limits ; shall be at the discretion of the officer issuing the warrant, and shall, together with any expenses incidental to arrest, be charged by the Accountant Officer against the pay of the deserter or straggler earned subsequently to arrest. PURCHASE OF DISCHARGE. 7. Petty Officers, seamen, ami others below the rank of Warrant Officer shall be permitted, subject to the approval of the Naval Authority, to purchase their discharge on the following terms : — (a.) Up to but not exceeding one month from date of first entry, £10. (i>.) After one month, but not exceeding three months, from date of first entry, £20. (c.) After three months from date of first entry — (i.) Boys under eighteen years of age, £40. (ii.) Men— (1.) Up to three years' service since date of engagement, £48. (2.) Over three years' and up to six years' service since date of engagement, £36. (3.) Over stx years' service since date of engagement, £24. Time served as boy shall not be allowed to count as "' service " under (ii). (tl.) After re-engagement — (1.) Up to four years' service since date of re-engagement, (2.) Over four years' service since date of re-engagement, £8. Service must be actual service in receipt of wages, as recorded on the service certificate. In special circumstances the Naval Authority may approve of the discharge of a rating without payment of purchase-money, or may reduce the amount of perchase-money required by the above scale. TRAVELLING-ALLOWANCES. Scale of Travelling-allowances. 8. (1.) (a.) The following are the rates of travelling-allowances which may be drawn by members of the Naval Forces when travelling on duty :—

(b.) The above rates of travelling-allowance are exclusive of any cost of conveyance by rail, coach, or steamer; and in computing the period the time shall be counted from the time of departure by train, coach, or steamer to the time of return by the same. (c.) When travelling by steamer or other vessel in which the fare paid includes subsistence, only one-quarter of the ordinary rates shall be allowed. (d.) Where it is proved to the satisfaction of the Naval Authority that the travelling-expenses a member is entitled to draw under these Regulations do not cover his actual expenses, the Naval Authority may authorize payment of an increased rate of travelling-allowance. (c.) The Naval Authority may reduce the rates of travelling-allowances under the scale when circumstances appear to justify such a course. (/.) When a journey is commenced and completed on the same day, and the member proceeds to a place not less than five miles from his station, he will be allowed necessary expenses for meals only, which must not exceed the following rates :—
In cases where the places visited are less than five miles distant no allowance for meals will be granted unless in exceptional circumstances and with the approval of the Naval Authority. A morning meal shall only be granted if leaving before 7 a.m., and an evening meal if returning after 7 p.m. (g.) Warrant officers, Petty Officers, and men, where practicable, will be provided with rations and quarters in lieu of travelling-allowances and any mess charges will be allowed them. (h.) Allowance in lieu of rations or lodging-allowance shall not be drawn when travelling-allowance is drawn. Cab-hire. 8. (2.) (a.) (Jab-hire shall be allowed only when, in the opinion of the Commanding Officer, such expenditure is expedient or necessary. (6.) Cabs should not be used when any other form of public conveyance which would meet the case is available. (c.) Officers travelling with baggage shall be allowed reasonable expenses for cabs, but in every such case the distance travelled is to be clearly stated. (d.) When cab-hire is claimed for more than 55., receipt for such payment must accompany claim. Claims for cab-hire at rates in excess of the legal fares are not admissible. Claims for hire of taxi-cabs shall not be admitted where the rates for hire of such cabs exceed the rates for hire of ordinary cabs. Conveyance of Baggage. 8. (3.). The scale of baggage allowed to be conveyed at the Government expense will be as laid down in Appendix IX, King's Eegulations, where applicable. Naval Authority. 9.
