“ UNBOUNDED MALICE ” JUDGE’S STRONG COM,MENT GROSS ABUSE OF LAW (United press Assn.—Elec. Tel. Copyright) (Received Oct. 19, 3.15 p.m.) MELBOURNE, Oct. 19 A woman plaintiff, who conducted her own case in the county court for six days, in an endeavour to establish her ownership of furniture which was removed from her house, oci cupied by her, at the order of her j husband, was ordered by Mr Justice I Foster to undergo imprisonment for j fourteen days. The woman was Edna Frances | Isaacs, and her husband, John Isaacs, j brother of Sir Isaac Isaacs, former i Governor-General and former Chief j Justice of the High Court. ! After deciding the claim against j the woman, the Judge said: “Never j in the long history of the Courts has j there been so gross an abuse of the j processes of the law as has taken j place in this case. She deliberately, j in spite of my efforts and warnings, j ignored the Court's rules and utilised 1 the opportunities which her own i cunning devised to denounce and de- ; “She is utterly unworthy of any credence, and she has been guilty of gross prevarication throughout the hearing. Her conduct revealed unbounded malice and vindictiveness. The evidence revealed that her j motive was greed. She denounced and besmirched her husband while mouthing her affection. “She accused Sir Isaac Isaacs of the vilest behaviour without the remotest shred of warrant or justification. In view of the publicity given to the case I wish to pay humble tribute to Sir Isaac, to his noble services to Australia and the grace with which he has adorned the highest office the country could confer on any citizen. “I direct her to pay all costs. I would be failing in my duty if I did not take appropriate steps to punisn this grave offence. I order her to remain in custody for fourteen days.”
