HILL V. WAIKATO COUNTY COUNCIL.
In the matter of the claim under the Public Woiks Act, ISS2, of George Hill, jun., and John Rowland Hill v. the Waikato County Council, which came on at the Supremo Court on Tuesday beforo Mr Justice Conolly, Mr Tole moved for an extension of time for giving notice requiring the claim to be heard by a Compensation Court. Cuptiin McPhorson, County Clerk, appeared to oppose the application, but Mr Tole objected to the clerk of the Council appearing, aud said that they ought to have instructed counsel to appear on their behalf. Captain McPherson claimed tho right to appear under section 4!) of the Public Works Act, but it was pointed out that that only referred to the Compensation Court, and His Honour decided that he could not bo heard. Ho would either have to instruct counsel, or he should have to hoar it ex parte. Captain McPhorson then askod Air Heskoth to take the case, and the papers wero handed to him by the Court. Ho retired with Captain McPherson, and in returning to Chambers, ho asked that the case might stand over till Friday, as he had not yet had time to get the facts from Captain McPherson. Mr Tole did not object, and the case was accordingly allowed to stand over.
