RESIDENT MAGISTRA TE'S COURT, HAMILTON.
Yesterday—(Before Capt. McPherson and Mr Searancke, J.P's.) criminal. H. LINGARI), a boy of eight years, was charged, on the information of Constablo Murray, with breaking windows at the Grand, Stand, Claudclands. Pleaded guilty. Tho Bench ordered the father to admonish the lad, and to pay the cost of tho action. civil. D.vvey v. A. Smith.—Mr O'Neill for plaintiff, and Mr Baume (of Auckland) for defendant. Claim £7 13s lid for groceries, &c, supplied. The Roods were supplied since a deed of separation between defendant and his wife had been made, and defendant had paid a visit to Ireland. Mr D.ivcy gave evidence as to the supply of the goods to Mrs Smith, in the absence of her husband. Mrs Smith was put through a severe cross-examination by Mr Baume as to her domestic relations with her husband and the use of tho goods supplied. Keen argument ensued between counsel, as to the legal liability of a husband, and the justification of a wife to pledge his credit. Several members of the family were also examined, to show that the cause of unhappiness was the wife's unchastity. The Court said it could not see how the defendant could be relieved of the onus of supporting his wife and children during his absence in Ireland, and for whom he had made no provision. Judgment for plaintiff for £6 3s and costs £2 4s.
W. McGregor Hay v. Barlow, re-hear-ing.—Mr O'Neill, for defend»nt, askod for an adjournment. Mr Hay strongly objected, but after considerable argument the Bench adjourned the case to two o'clock today. A few other civil cases were disposed of.
