HAMILTON BOROUGH COUNCIL. •

The usual fortnightly meeting of the council was held on Monday evening, when there were present, His Worship, the Mayor, Crs. Jones, Gaudin, - MeGarrigle, Hill, and Peat. A" letter from Mr J. S. Milne, complaining of the condition of the road leadirig to the .Frankton Railway Station, was referred to the works committeee to make enquiries as to whether the portion of road indicated was in the Hamilton Highway District or not. The Works Committee reported, recommending : — "That tenders be invited for forming the Peach grove road ; that the public be notified by advertisement that the road bounding the farm of Mr John Runciman should be \ised as an approach to the Hamilton East cemetery, instead of the old road ; that they saw no reason to take action in regard to the landing made by Col. Lyon on the river bauk opposite his residence ; that there was no immediate necessity for forming footpath in Collingwood-street,,as desired by Mr W. M. Hay, but that should the path be formed, the council should gravel same. — After some discussion the report was adopted, it being understood that Col. Lyon should be asked to make provision for the due protection of the river bank at the spot indicated. — The statement of accounts was read as follows :— General account, (overdraft) £230 18s ; special fund account, (credit) £153 13s.

Leasing Borough Endowments. The Mayor announced that the next business on the order paper was to fix the upset price for allotment 411, borough endowment, applied for by Mr J. A. Bradley, on behalf of the W.S.N". Co. Before going into the matter, he would like to know whether the council had power to dispose of the foreshore. He thought this should be ascertained, because without the right to the foreshore the allotment would be of no use to the applicants, provided they puchased the lease. — Cr. Gaudin said the council had nothing to do with that ; they could only lease those lands which they had under their control. The matter of the foreshore had nothing to do with the council. — Cr. McGarrigle moved, " That Mr Bradley's application be acceded to." — The Mayor said the business before them had nothing to do with the application. They had to fix the upset price on the allotment. He had heard that day that an attempt would be made to rush this matter through against all opposition. He deprecated such a course, and reminded the council that in dealing with the endowments they were legislating for 21 years hence. He did not think the present a favorable time for disposing of land, and were the case his own he would hesitate before taking any decisive measure. — After some further discussion, the council, on the motion of the Mayor, went into committee to consider the question. — It was resolved, on the motion of Cr. McGarrigle, seconded by Cr. Jones, " That lot 411 be offered by lease for auction for 21 years, at an upset price of £12 10s per annum, payable halfyearly in advance." — Cr. Peat moved and the Mayor seconded, " That Mr Bradley, the applicant for lot 411, be requested to furnish a sketch plan, certified to by a surveyor, of the portion of the allotment applied for." — Cr. Gaudin moved as an amendment, seconded by Cr. McGarrigle, " That Mr T. G. Sandes be instructed to furnish the council with a sketch plan defining the land in question applied for." — The Mayor protested against the expenditure of the borough funds for such a purpose. He considered that the duty of defining the portion of land required clearly devolved upon the applicant. — Cr. McGarrigle contended that no such service had been required of other applicants. — The Mayor explained that in no other cases had poitions of allotments been applied for. — A division was then taken as follows : — For the amendment : Cis. Jones, Gaudin, Tippen and McGarrigle ; for the motion : The Mayor, and Crs. Hill and Peat. — The amendment was therefore declared carried. — On resuming in council, the motions passed in committee were confirmed, and the council then adjourned till 7.30 p.m. to-day.
