WESTPORT WARDEN'S COURT.

Tuesday, October 10. (Before J. Giles, Esq., Warden ) An application was made by Otto Tiller for a goldmining lease of ten acres of ground, situate at German Terrace. An objection had been lodged by George Goodall and party, setting fortlr that the applicant had enclosed within the boundaries of the proposed leaso a claim belonging to the objectors. The surveyor's report was favourable to the granting of the application. It described the ground as " bounded on tho north, east, and west by unoccupied ground, and on the south by Peterson's claim (three men's ground, double area), and partly by Hornick's extended claim. None of the ground applied for had been worked yet. A tunnel was put in towards the north end from the Orawaiti by Rowlandson and party, who held an extended claim, which included the northern part of the lease applied for ; but that party found no gold, probably owing to the tunnel being at too low a level. Tiller and party intend driving a tunnel, and prospecting for the back Caledonian lead, which has been traced to within two claims south, and no doubt continues still further north. Some time before the ground was applied for by Tiller, an ordinary claim of six men's ground was pegged out by Goodall and party, who objected to the granting of the lease, and this claim is included within its boundaries. Goodall and party intended to put up a shaft from Rowlandson's old tunnel, and drive from it to prospect the ground. The applicant stated that he had instructed the surveyor to exclude the objector's claim. The latter urged further objections, but the Court declined to entertain them, the objectors having failed to lodge the £5, in accordance with the regulations. The Warden decided to recommend the grant of a lease of five acres. The complaint of Williams and party, Old Diggings, against William Hoare resulted in a nonsuit. The matter of complaint was that the defendant interfered with the complainant's dam, by reason of a water-race, which deprived the complainants of all water above a certain level. The latter sought that the defendant should be ordered to remove the course of his race.

The defendant produced a certificate of prior right, whereupon the complainants were nonsuited.
