CHARLESTON.

WARDEN'S UOURT. Tuesday, April 18. (Before C. Broad, Esq., Warden.) Moniot- and party v. Sullivan. The plaintiffs alleged that the defendant had allowed water to flow on their claim, after the order, made by the Court, damaging them to the amount of £25. Mr Brou appeared as interpreter for the plaintiffs. Rotnaz, one of the plaintiffs, stated that the defendant had continued to send down water on their claim after the order of the Court. He had asked the defendant to desist but he refused. He considered that they had lost £25 in consequence of being kept idle for about a month. The Warden said that tbey could only sue for damages sustained since the judgment given on Friday last. Myrick Jones, Cornelius Cronin and C. Brown were called to give evidence for the plaintiffs. James Sullivan, the defendant, stated that he turned off all the water from his race on Friday last, in order to comply with the Warden's order, to divert the water from the plaintiffs' claim. The water that had flowed in his race was storm water. A was;es man and himself had been engaged in cutting a race across the road to comply with the Warden's order. Cornelius Cronin stated that he had seen the defendant and his wages man cutting a channel across the road to divert the water.

His Worship said that be would have to dismiss the case, as it had been proved that the defendant was complying with the order of the Court.
