ALLEGED PERJURY.
THE CASE DISMISSED. The charge of perjury against Constable Nestor, opened at Masterton on Wednesday, was resumed at the Masteiton S.M. Court to-day. Walter Wra. Bodmin was called, but failed to put in an appearance. Mr Beard stated that Bodmin, who had been served in Auckland, forwarded a communication, stating that he had important business to attend to, and could not leave Auckland till Tuesday next. His Worship said that it was very important that tho witness should be present, as the session commenced pn Monday, and a furthor remand meant that the copstabloyould have this charge hanging over his head for another three months. The Crown should have seen that a material witness was within hail before laying the information. Mr Bunny objected to any further remand. The summons was served in plenty of time for flodmiii to havo been present, The rompd was refused and the informations were dismissed, His Worship stating that the Crown could lay fresh informations if tho I Department wished,
