MASTERTON.-FRIDAY,
(Before Colonel Roberta, R.M., and Messrs M. Caselberg, Wm. H. Beetham, and J. Gardiner, J.P.'s). ASSAULT. Gelitts Petersen was charged with that he did on the 2nd May unlawfully beat John Jenaen, of Mauriceville. Mr Beard appeared for the plaintiff and Mr Pownall for tho defendant.
John Jessen, sworn, deposed: I met the defendant on the roud at Mauriceville on May 2nd, He was sitting in a trap together with Mr Keen. He spoko to mn uliout certain moneys owing, and I said I did not know that I was owing him any money. I referred him to my son, He then gripped me by tho nose, and jumping out of tho trap struck and shook me. The skin was taken off my noso, which bled freely, I have to pass along the road every day, and I therefore wish the accused to be bound over to keop the peace, By Mr Pownall: I did not threaten the accused with a stick, Charles Isaacson gave corroborative evidence, For the defence Mr Pownall said tho case, like all others from Mauriceville, was a very trumpery one. Celius Petersen, the defendant, de.< posed : 1 know Mr Jessen, I saw him as I was driving in a cart on 2nd May. I had seen his son and had an argument with him in the morning about sumo fencing, When I waß passing tho informant I stopped and said " When are you going to square npforthe fence ?" Hureplied, 11 1 will swear any lime that my son has paid you," I then said " You are a nasty man," whereupon he put up his stick as though he was going to strike me. I jumped outof the trap and asked him if ho was going to fight me, or what. He camu towards ine and was trying to spit in my face, when I shoved him back, I wanted to go Hway, but Jessen got between nie and the cart and tried to prevent me. I ./id not pull his nose, J have no bad feeling towards the informant, I have done him a lot of good and will continue to do so (laughter), I got out of the trap because I was afraid of getting a hiding with the Btick, Harry Keen corroborated the evi ■ dence of the delendant. The Bench dismissed the informa' tion, without costs.
BREACH OF BY-LAWS, Edward Braggins pleaded guilty to allowing his goat to bo at largo in a street of Masterton, and was fined Is and 2s costs, FAILING TO PROVIDE, Alexander Smith was charged with failing to contribute towards the maintenance of his wife, Mary Siaicb, as required by an order of the Court, Mr Pownall, who appeared for the defendant, stated that bis client had money coming to him, and would pay bis arrears as soon as he got it. The caefi was adjourned for a week,
