R.M. COURT.
MASTERTON -WEDNESDAY. (Before Colonel Roberts, R.M.) LARCENY AS A BAILEE, Samuel Calverley was charged on the information of John Beale, of Featherston, with larceny as bailee ofablaek mare, saddle and bridle, between the 6th March and 10th May, Mr Beard appeared for the accused.
Informant deposed that ho was ranger at Featherston, and lent the animal in question to iiccused who was at the time his assistant for the purpose of riding lo Masterlon. Saw liiui subsequently in Master ton and he promised to return the maro on the following Friday wetk, As he did not do so an information was laid. In cross-examination informant admitted that ho was under a wrong impression when ho laid the information as he thought the accused had sold the mare,
John Balos deposed that lie advanced 30s to accused on the security of the mare, saddlo, and bridle, about three or four months ago. Understood he had purchased the maro until accused came up and got it back again.
Cross examined: Hud been satisfied for liis claim. Had no lion on the mare and never used tho animal, William Kebble stated the accused offered to sell tho mare to Mr Ncill and then offered to sell it to witness. He wanted L 3 for it, but witness refused to purchase, Accused next day said he had sold the mare, saddle and bridle for 30s to last witness, who took it away.
Constable O'Connor stated that when arrested accused said, "I have not sold tho horse."
Mr Beard having addressed the Court, tho information was dismissed.
