Three separate judgments were read ill this case, Justice Johnston was of opinion that tho appeal be dismissed with costs, Justices Gillies and Williams thought decree of Court below should "be affirmed, Judgment accordingly affirmed. Stone v. Atkinson (Auckland); appeal in this case dismissed with costs to be awarded on highest scale. Leave was given to appeal to Privy 'Council.
