Westport, June 11.

McHerron and Kittson, who were charged with criminal libel published in the Charleston Herald, were before the District Court today. Mr Hannon, for the defence, raised the point that no such offence existed in New Zealand as criminal libel since the passing of the Criminal Code Act, and if it existed under the English statute previously it was implicitly removed by the Criminal Code. Judge Ward adjourned the Case until the decision of the Court of Appeal is given on the point raided by the Chief Justice in the Nation case at Wellington.
