ACCIDENT TO CYCLIST RESERVED JUDGMENT GIVEN. Reserved judgment has been delivered by Mr 11. P. Lawry, S.M., in the case of the W.A.A. Mutual Insurance Co. v. K. G. H. Udy, recently heard at Featherston. The defendant was insured with the plaintiff company under the Motor Vehicles Insurance (Third Party Risks) 1928. On March 19, 1941, defendant was driving his motor-car on the Main Road at Pahiatua when he collided with a cyclist who was injured. The cyclist brought court proceedings against Udy and the plaintiff company as his indemnifiers was required to pay £lO9 17s. The company sought to recover from Udy the amount so paid on the ground that the defendant had failed to notify the company of the accident forthwith as required by the statute. In the course of a lengthy judgment the Magistrate held that the defendant had not notified the company for at least 40 days and that after such a delay the notice given by the defendant was not a “forthwith” notice in accordance’ with the Act. Judgment was therefore given for the plaintiff company for the amount claimed with costs according to the scale. At the hearing, Mr H. Lawson appeared for the company and Mr A. M. Ongley (Palmerston North) for the defendant. Personal. Sergeant Pilot John Lawson, N.Z.R.A.F., is home on leave. Miniature Rifle Club.
