SECTION SUBDIVISION

APPEAL UNDER MUNICIPAL CORPORATIONS ACT. DECISION FOR APPELLANTS. An appeal by Messrs J. Bolton and Sydney Smith under the Municipal Corporations. Act against the decision of the Masterion Borough Council in refusing to consent to a subdivision of a section at Terrace End Street was heard in Masterton Before Mr H. P. Lawry, S.M., and two assessors, Messrs Alex Keith and A. W. Reynolds. Mr C. C. Marsack appeared for the appellants and Mr H. Mackenzie Douglas for the Borough Council. It was contended on behalf of the council that the dedication of Terrace End Street, which was a cul-de-sac, was accepted by the council on the express understanding that the sections fronting the street should not be subdivided into smaller areas than those shown on the plan submitted to the council in 1927. This condition was not set out in the minutes of the council’s proceedings nor could it be registered against the title to the land. The Magistrate held that there was nothing to indicate to Bolton the conditions attached to the subdivision of the section l and as the section was of a reasonable size he allowed the appeal.
