OHAKUNE DISTRICT COURT

The following cases were heard in the Ohakune District Court last Thursday (22 October) by Judge E.W. Unwin. Detective Sergeant Harry Mallalieu of Taihape appeared for the police prosecution and Traffic, Officer Bruce Carr of Turangi appeared forl the Ministry of Transport. ★★★ Dennis Mason Peihopa Bishop, 19, unemployed labourer of Ohakune, was remanded, without plea to appear in i the Ohakune District Court on 26 November on a charge of being found without lawful excuse on a property at 11 Conway Street, Ohakune on 19 October. He was remanded on bail for a drug and alcohol assessment report to appear in the Ohakune District Court on 26 November subject to residing with his mother and to observing a curfew from 8pm to 7 am daily. Failure to observe these conditions could result in arrest and a prison sentence of up to one year. Counsel: P. Brown. ★★★ Denise Cribb, 20, market garden worker of Ohakune pleaded guilty to one charge of having no driver's licence but not guilty to a charge of fail-

ing to give way. The charges related to an incident on 11 August at the junction of Ayr and Clyde Streets, Ohakune. Defendant was remanded to appear on both charges to 17 December. Counsel: P. Brown. ★ ★★ Charmaine Larisha Green, 25, solo parent of Raetihi, appeared for a defended hearing on one charge of permitting premises to be used for the commission of an offence under the Misuse of Drugs Act, and one charge of possession of utensils. However, because her Wanganui-based legal counsel was not available, defendant was remanded by consent to appear in the Ohakune District Court on 17 December. ★ ★★ Hamish Phillip Henderson, 21, shearer of Pipiriki, appeared for sentence on a charge of burglary to which he had pleaded guilty at last month's sitting of the Ohakune District Court. In passing sentence Judge Unwin said that while the defendant's explanation of needing the clothes and boots in order to start a new job and being under the influence of alcohol at the time of the offence, such behaviour was too prevalent in the Waimarino. Defendant was convicted and sentenced lo a 9-month

period of supervision during which he was to undertake drug and alcohol abuse counselling. He was also ordered to pay $300 towards the cost of prosecution and ordered to make reparation of $300 at the rate of $20 per week or face a 90-day sentence of imprisonment. Counsel: P. Brown. ★★★ Phillip Jerry Hiroti. 18, unemployed labourer of Raetihi, pleaded not guilty to a charge of assaulting Todd Peck of Raetihi, on 27 June, He was remanded on bail to appear in the Ohakune District Court on 26 November for a defended hearing. Counsel: D.G. Harvey. ★ ★★ Vernon Leslie McLeod, 18, unemployed labourer of Ohakune, pleaded guilty to a charge of burglary committed on 9 October. Court heard how defendant, with two accomplices (one who appeared in the Children and Young Person's Court and another who is currently serving a prison sentence) broke into a building at 11 Conway Street, Ohakune, and stole property (including clothing, bedding, television set and other items) to the total value of $5000. The defendant and his accomplices later returned to the property the walls and

windows of which they sprayed with tomato sauce thereby causing $500 damage. Because the defendant was serving two communitybased and attempted rehabilitation sentences when these latest of fences were committed an application for bail was refused. Instead he was remanded in custody to appear in the Wanganui District Court on 2 November. Counsel: D.G. Harvey. ★ ★★ Duncan Vincent Metekingi, 34, unemployed of Raetihi, appeared for a defended hearing on one charge of illegally acquiring a controlled pesticide and one charge of permitting premises to be used for the commission of an offence under the Misuse of Drugs Act. However, because his Wanganui-based legal counsel was not available, defendant was remanded by consent to appear in the Ohakune District Court on 17 December. ★ ★★ Hillary Pirihita Metekingi, 30, housewife of Raetihi, appeared for a defended hearing on a charge of possession of cannabis to which she had pleaded not guilty at the July hearing of the Ohakune District Court. However, because her Wanganui-based legal counsel was not available, defendant was remanded by

consent to appear in the Ohakune District Court on 17 December. ★★★ Stephen Patrick Munro, 17, shedhand of Raetihi, was to have appeared on a charge of causing intentional damage in Seddon Street, Raetihi on 19 October. Following his failure to appear in court to answer the charge a warrant for arrest was issued. ★ ★★ John Kevin Shane Phillips, 26, tour bus driver of Auckland, was scheduled to appear in Court to face a charge of assaulting Peter Desmond Fitzgerald on 17 July. However, because there was no proof of service, the hearing of the charge will be in the Ohakune District Court on 26 November. ★ ★★ William Peter Pikari, 27, scrub-cutter of Raetihi, was to have appeared on a charge of using obscene words in a public place (Seddon Street, Raetihi) being reckless as to whether any person was alarmed or insulted by those words. Following his failure to appear in Court to answer the charge a warrant for arrest was issued. ★★★ Andrew Bruce Thompson, 19, painter of Ohakune, pleaded guilty to one charge of driving with excess blood alcohol in Mangawhero Terrace, Ohakune, on 18 June and to one charge of driving at a speed of 70 km/h in an area restricted to 50 km/h at the same place and on the same date. On the first charge he was convicted and fined $375, court costs $55, disqualified from driving for 8 months and ordered to pay $82 medical expenses and $59.40 DSIR fees. On the second charge he was convicted and discharged. ★★★ Christopher John Zimmerman, 32, fore-

man of Raetihi, was to have appeared on one charge of failing to stop at the signal of a Traffic Officer on 12 May and on one charge of intentionally obstructing a Traffic Officer in the execution of his duty on the same date. Following an application from legal counsel, the case was adjoumed until 26 November. Counsel: D.G. Harvey.
