staled that till© case was one which should have been heard before a jury of four, and he could not undlerstaind why it hiad been thought necessary to make tine claim so large as to require a jury of twelve. To mark his disapproval, Bis Honor allowed expenses for a jury of four only. The. finding of the jury, afiter the pointed summing up of Sir Robert Stout, came as a great surprise. Whether the verddot would have been different hiad there been a jury of four, it is, of course, impossible to say. Nevertheless, it seemed as though, the processes of the Court had been availed of in a way that was scarcely contemplated by the Legislature.
