J.D. CRUICKSHANK AND CO., LIMITED.
JOHNSTON AND CO.'S PETITION DISMISSED.
Judgment was delivered yesterday morning by Mr Justice Cooper in the petition by Messrs Johnston and Co., Limited, against J. D. Cruickshank and Company, Limited, to have the latter Company compulsorily wound up. The petition was opposed by Cruickshank and Company, Limited, by the creditors of the Company, and by a number of fully paid-up shareholders. At the same hearing the private liquidator, Mr W. B. Chennells, applied for the approval by the Court of the agreement offered by Mr Perry to take over the Company's business and pay all its liabilities in full. . In delivering judgment, His Honour -dismissed Johnston and Company's petition, with costs £5 5s each, to the Company and its creditors, and he made an order approving of the agreement offered by Mr Perry. At the hearing, Johnston and Company, Limited, were represented by Mr H. D. Bell, K.C., and Mr H. T. Johnston; Cruickshank and Company, Ltd., by Mr U. B. Morrison; the creditors by Mr H. Von Haaste; and the shareholders by Mr D. TC, Logan.
