ARBITRATION COURT PROCEEDINGS. MOTION FOR AN ORDER. BY TELEGKAPH —PRESS ASSOCIATION. AUCKLAND, May 11. At the Arbitration Court this morning, Mr J. A. Tole, K.C., Crown Solicitor, moved for an order to enforce against the union itself on March 12th, or for such order as the court might think lit, upon the grounds that: (1) Court had fined the unio.i £75. (2) That, pursuant to the Industrial Conciliation and Arbitration Act, 1905, a certificate of the fine had been x lodged in the Magistrate's Court, Greymouth. (3) That on the 22nd April, the Magistrate at Greymouth granted a warrant of distress to levy £75 and costs of execution. (4) That on the 23rd April the bailiff returned the warrant of distress, noting that he could not find sufficient goods and chattels whereon to levy the fine. (5) That the sum of £75 was still due and payable, and that the property of the union was insufficient to satisfy the judgment of £75, and that the members of the union were liable for the deficiency. Mr Tole said he had communicated with Greymouth after the case was adjourned, and asked that the union be notified of the hearing to-day. He had received a reply that the strikers were quite aware ot the adjournment and of the hearing to-day. He also stated that no documents or affidavits had been filed in the Arbitration Court in answer to or in opposition of the application he was then making. The crJer that he asked the court to make was that individual members would be ordered to pay the amount of fine, provided that no member was liable to pay more than £lO : that the said members within one. week of the making of the order be notified of the effect of it, either through the secretary of the union of workers, or t)v advertisement published in Greymouth, and that, in default, or within so many days of that notification, that certificate of order be forwarded to the Magistrate at Greymouth, to the end that such proceedings might be taken according to 'aw. The Blackball Union were r.ot represented. His Honor intimated that the court would consider the matter and advise Mr Tole.
