TAILORS' CASES BEFORE THE ARBITRATION COURT. By Telegraph—Press Association. AUCKLAND, April 10. At the Arbitration Court to-day, the Tailors' Union charged Macky, Logan, Caldwell and Co. with committing a breach of the tailors'award, in that they failed to mark as "factory made" in the prescribed manner a suit ordered by John Court, in that the words "factory made" were not stamped or printed on the hangerup of the coat, or in the waistband lining of the trousers. Mr C. J. Parr, who appeared for the respondents, submitted that the case was in excess of the jurisdiction of the Court, in that the clause of the award under which it was brought was ultra vires, not being concerned with an industrial dispute, but protecting one branch of the trade against another. Mr Justice Chapman had so ruled when an application was made to include a similar clause in the Wellington award. It was shown that although the words were not on the hanger-up, they were stitched on the coat, and that the label had been removed from the trousers, the stitching being still observable. "Did you advise the union to bring this case?" asked his Honour of Mr Prendergast, who appeared for the union. "It was brought before I advised them," was the reply. "It would have been better if you had advised them not to bring it at all," said his Honour. Mr Prendergast: "That label can be cutoff." His Honour: "So can the hangerup. The label is more permanent. The case is a waste of time. It should never have been brought." The case was then dismissed, costs £2 2s and witnesses' expenses being allowed. A similar case . was brought against F. M. King, on the ground that the garments concerned were stamped "factory made, equal to tailor made." Mr Prendergast submitted that two words only should appear. His Honour ruled otherwise, but pointed out that the words "tailor made" were much larger than "factory made." "I think you are sailing very close to the wind,"jsaid his Honour. "It has not been done since the matter was pointed out," replied Mr King. The case was dismissed.
