THE IZARD BANKRUPTCY.

Henry Stratfon Izard, bankrupt solicitor, of Greytown, who was arrested on warrant, at Greytown, on Friday nigh*, on several charges connected with the deficiencies in hie bankrupt estate, appeared before Mr W. P. James at the Masterton Magistrate's Court, on Saturday, morning, to answer the charges. The Court was tilled with interested spectators. ,

Alternative charges were preferred against the acoosed under the Criminal Code Act, 1893, for fraudulent conversion of aeoarl tioß and criminal breaohes of trqet. There were In ail thirteen indiatable charges against the accused, but only the two following charges were read to him on Saturday:— (1) That -jr trustee in the estate of Martha Mabapuku he received as such trustee on terms requiring him to acoount to the same for the said Martha Mabupjku securities amounting in all to £2,690, being motieys lent and advanoed by the said Henry Stratton Izard as trustee of the said estate, and oat of the trmt fund thereof. The said Henry Stratfon Izard, by memorandum . of mortgage, registered No. 52,624, dated the* 7th day of April, 1896, from himself to olive Wordsworth Fowler and Gonstanoe Buchanan Tully, fraudulently converted to bis own use the said valuable securities and thereby obtained the sum of £2,000 from the said Olive Wordsworth Fowler and Constance Buchanan Tully, for his own use, being an indictable offence under the Criminal Oode Act, 1893; section 220. (2) That as trustee in the estate of Martha Mahupuku received as such trustee on terms requiring him to account for "the same to the said Martha Mahupuku, the sum of £28,000, and has fraudulently converted the sum of £15,976 17s 6d, part thereof, to his own use, being an indiotable offence under the Orim inal Code Act, 1893, section 220. The other charges, which were not read, wore similar to the proceeding ones, and were in respeat of I 1 the following trusts-Thus. Conwell £SOO, Mrs C. Rogers £IOO, Bank of New South Wales, (Mahupuku trust,) £2 ; 500, Fowler and Tully £2,690, W. H. P. Jones £SOO, Keedwell, (Fuller's mortgage,) £325, Wallis, £IOO. Tbe amount involved in ail tbeobarges is £22,691 17s 6d. Mr B. J. Dolan proseouted on bwhalf of the Crown, and Mr C, A. Pownall, under instructions from MrJC. P. Skeirott, appeared for the accused.

Mr H, 0. Robinson watched the proceedings on behalf uf the Mabupuku Estate. Mr Pownall applied for a remand. In asking foi bail be stated tbat tbere should be no objection to bail as the accused bßd been in Australia iep ntly and had oome fcaak fully prepared to meet the charges. Mr Dolan said that the accused was not bailable as a right, but the Magistrate had discretionary power in the matter. Counsel submitted that the bail should be substantial. The Magistrate thought that it was a case in which he might grant bail. The fact that the aocused had returned from Australia was in his favour, but it was his duty to see that the amounts of the sureties were made substantial. The accused was then remanded to appear on December 31st. Bail was fixed in one surety ofj self at £2,000, andjtwo other sureties of £2,000 enoh. It is probable that the aocused will bo further remanded when ht appears on December 31st until after the Court holidays. It is understood that further charges under the Criminal Code Act, and the Bankruptcy Act are pending against the accused. The necessary bail sureties were found on Saturday afternoon by Messrs H. Williams and Gt A. Pownall,
