RESPONSIBILITIES OF THE POLICE.
AN INTERESTING DECISION. Receivdcl Maroh 16. 10.42 a.m. MELBOURNE, March 16. The question of whether a police Constable is personally liable for his own acta, or wbetlior the Governmen, Which employ him is resnon Bible, has been dealt with by the Court, Plaintiff obtained a verdict in the lower Court in Tasmania against the Government for wrongful arrest. The Full Court quashed the verdict and an apteil was taken to the High Court, which confirmed the Full Court's decision, holding that an authority to ari'est was not conferred upon tlitf Government nor exercised on lielMlf of the Government, but was conferred on a constable as the holder of a public office, to which well-known duties and responsibilities attached. 'lhe arrest in question, fcfoa Court ruled, was made in the discharge of a duty as the holder of the office of constable, and not by the direction or under the control of the Government. The relation of master and servant between the constable and the Government oould not be implied.
