WARDEN'S COURT, LAWRENCE.

(Before E. H. Carew, Esq., Warden.) Wednesday, Ist July.

In the* matter of the application of Stewart M'Combe for an agricultural lease of section 37, block XVIIL, his Worship said he had seen the ground. He would not be inclined to grant a lease of some of the land bordering the gullies, which was probably auriferous, and this would render the fencing of the rest difficult and expensive. He would hold the application over until Mr. M'Coy had an opportunity of conferring with his client. Neil v. Doyle — This application alleged that tho parlies were partners in a race held under licenses numbered 514 and 1535, and that the defendant refused the complainant access to the licenses, and claiming that the defendant should be ordered to hand the same over to the complainant. Mr. M'Coy, who appeared for the defendant, urged that the Court had no jurisdiction^ the parties were co-owners only, and not partners in law ; and that, if it had jurisdiction, it should not interfere, as each had an equal right to hold the licenses. His Worship said he thought the Court hadjurisdiction independently of the question of partnership, which he thought it was not necessary for him to consider, and under the circumstances (as he thought the rlpfpndant was obstructing tixa ouuipiaiuaut) ordered the defendant to hand over the licenses, and pay 10s. expenses and costs of Court, 16s.

Robertson v. Campbell (as and being manager of the Otago Gold Mining Company, Registered). This was a friendly complaint alleging that the defendant had failed to renew a certain water license, and claiming that he should pay such penalty as the Court should award. The defendant pleaded guilty, and was fined ss. and costs of Court, Bs. Mr. M'Coy for plaintiff. The application of Lacklan M'Millan for an agricultural lease of section 33, block XVIIL, Tuapeka East, was granted. The application of John M'Gowan Clark for agricultural leases of sections 47 and 48, block X., Tuapeka East, were withdrawn. The same sections were applied for by Daniel Hunter, and this application was opposed, by John Pearson, on the ground that it was not bonafide. Mr. Henderson appeared for the objector. The applicant, on being sworn, said that the applicant was made bona fide. Granted as to section 48, and granted subject to survey as to section 47. The applications of John Crozier for an agricultural leaße of section 32, block IV., Waitahuua East, and of Timothy O'Lleary for section 5, block XIIL, Tuapeka East, were adjourned for survey, as was also the application of Issac M'Farlane for a gold mining lease.

The application of Isaiah Mcc for a residence area was granted.

The application of John Thornton Turner for an agricultural lease of section 5, block VI., Tuapeka East, was adjourned for enquiry, as it appeared that there was a lease granted of the land some years ago, wmchhad not been taken up, but which would require cancellation before the ground could be disposed of.
