Monday, 9th September. (Before Mr. Warden Pyke.)

Connack v. M' Nab and others. — Claim of LlO, for damages caused by trespass on a mining lease. Mr. Monat appeared for plaintiff; Mr. Copland for defendants. The trespass was admitted. The Warden asked for evidence as to the amount of damage done. Mr. Mouat called plaintiff, who stated that defendants had, without hia permission, cut a race across his claim, which had carried away about 100 cubic yards of ground, and threatened to do further damage. The value of the ground he estimated at 2s. per cubic yard. William Kell estimated the quantity of ground carried away at a "day's running." Mr. Copland called defendant M'Nab, who said he was not aware that the race was on Cormack's ground until he was served with an injunction and summons. A. G. Thompson srave similar testimony. The Warden gave judgment for L 9 155., with 22a. costs and professional fee, 21s.
