(Before Mr. Warden Pyke.) Wednesday, 4th September.
Neil v. Tyler and others- -This was a complaint alleging that the defendants' extended claim, situated near Docherty's Hotel, was net occupied by a sufficient number of holders of miners' rights, «nd had, in fact, been wholly unwrought for the space of six. weeks, and praying for the cancellation of their certificate. Hia Worship said that, though the evidence was not very clear, it was apparent to him that the complaint had been substantiated, in that the requisite number of holders of miners' rights had not been employed on the ground ; but thought it was uot a case calling for the cancellation of the certificate of the defendants. The Act allowed him to substitute a penalty, and he accordingly fined the defendants L 5 and costs LI 17s. — L 3of the fine to go to the complainant. Mr. M'Coy Appeared for the complainant ; Mr. Mouat for the defendants.
