Oiidaille v. Campbell. — Summons not served. Adjourned for fourteen days.
Sams v. King. — Claim, £25 11s., amount of dishonoured acceptance. The defendant stated that he was under the impression that Harris was charging him with 20s. interest per month. There being no evidence to show that such was the case, judgment was given for tho amount claimed, with costs.
Martin v. Coverlid. — Claim for £1, amount due for four dozen soda water bottles taken by defendant from plaintiffs residence. Mr. M'Uoy appeared for plaintiff. Defendant said he had seen some bottles at plaintiff's residence, which he believed were his. He made enquiry after pbiintiff, but could not find him. lie then took possession of the bottles. Plaintiff said he had collected the bottles found at his house at Waipori, and Waitahuna, from hedges, ditches, and waysides. He found that plaintiff had taken them, and he charged him os. per dozen as the price of bottles had risen in Duneliu. On being cross examined by defendant, plaintiff could not tell how many he got at Waipori or at Waitahu la, but said he never took any bottles from hotels. H. Robinson stated that bottles like those in dispute (soda water) were imported to the district some nine or ten years ago. In addressing the Bench, Mr. Coverlid stated I hat for years he was the only terated water manufacturer in the district; that every year it cost him £30 for bottles; and the price in Dunedin was 2s. 3d. per dozen by the gross. He was satisfied the bottles were his, as he fixed the wire different from any other manufacturer. The Magistrate stated that the course the defendant took in removing the bottles had taken the ground from under his feet. If he thought the bottles were his, he ought to have taken the proper steps. He considered, however, that the price was too high, and would give judgment only for 3s. per dozen, and costs of court.
