RESIDENT MAGISTRATE'S COURT, ROXBURGH.
(Before J. B. Borton, Esq., R=M.) Wednesday, «sth. June.
Police v. M'Pheroon. — This case was a prosecution under the Licensing Ordinance, 18C5, for permitting gambling to be carried on in the Roxburgh Ferry Hotel, of which the defendant is the licensee. This case was postponed from last Wednesday. Constable Daley prosecuted, and called witnesses to show that on the night of the 22nd May they had been engaged in playing cards in the above-named hotel at a late hour, and it appeared that some money passed. For the defence it was elicted, in cross-exami-nation, that M'Pherson did not return until late, having been absent at an Odd Fellow's ball, and on his return he found the gambling, and took away the cards . The Magistrate said that, under these circumstances, he would only inflict the sum of one shilling as a fine — this is the lowest penalty allowed by the < Jrdinance. Mr. M'Coy appeared for the defence both on'the 29th May and the sth June.
