DISTRICT COURT.

(Extended Jurisdiction.) (Before His Honour Mr. Justice Grey.) Thursday, Oct. 13.

Lancaster v. White. — Claim of £62 11s 6d on a bill of exchange, and for cash lent. Mr. M'Coy appeared for the plaintiff. The defendant did not appear. Upon the various items being proved, his Honour remarked that there werp many items in the account without any date, and he considered that if the rules of the Court were worth anything, they ought to be attended to. For the future, when the defendant did not put in an appearance, he would insist upon strict compliance with the rules of the Court. (305., being the amount of a transaction out of the district, was struck off.)

Mr. M'Coy explained that this process was sued out and served before it was placed in his hand 3, and he could not not then amend it, but quite recognised the importance of the remarks made by hia Honour.

The Judge said he was aware of the fact as stated by Mr. M'Coy, the summons having been issued four months ago.

Verdict for the amount claimed with costs of Court, and three guineas professional costs.
