M'B'-sath v. O'Gorman. — No appearance. Struck out. Gascoigne v. Pearson. — Claim, JE2,
being damages done to plaintiff's gate by defendant's horse. The plaintiff proved the damage to the gate. Verdict for plaintiff 20s. and costs.
Low v. Blair. Claim, £3 165., balance of an account. Defendant stated that he had offered the money to plaintiff some time ago, and would not take it, but abused him by using bad language and offering to fight him. Verdict for amount claimed, with costs of Court only. Young v. Treloar.— Claim, £12 183., for wages due. The plaintiff brought evidence that he was engaged by defendant at the rate of 6s. per diem and his dinner. The plaintiff worked eight weeks at that rate, and two weeks at 203., Treloar provisioning him. Defendant endeavoured to prove that the agreement was for 20s. a week and his food , that his food was always cooked for him, and if he did not take it, it was his own fault. He was always asked to have his meals. This the plaintiff distinctly denied. There was a grave discrepancy between defendant, and his wife as to the place where the engagement was entered into. The Bench, after consulting, gave verdict for amount claimed, with costs. The Bench remarked that but for the glaring discrepancy between the evidence of defendant and his own witness, which threw a shade of doubt over all their evidence, they might be inclined to come to a different conclusion. The Bench further remarked that this was another instance of the good results of all witnesses being out of Court.
