WARDEN'S COURT.
(Before H. Kenrick, Esq., Warden^/ Chappell v. Petbbs.—The plain/iff prayed that the ground known as the Mystery claim at Waitekauri should be forfeited on the ground of non working.— Plaintiff deposed that defendant was to have registered the ground, and plaintiff was to have had an interest in it; he had discovered that another person had been "laid on" to take steps to secure the ground, and so do the plaintiff and others out of it. The mine had not been worked. The mine was abandoned by Peters.' —The defendant stated that be and another man had pegged out the ground, and he had abandoned it. Chappell was always a partner in the Mystery.—The Warden granted the order prayed for, and ordered the defendant to pay costs, £4 4s. Fbasbb and Biley v. Tbeqow^th.— This was a case calling upon the last named party to sustain his objection to the granting of an application made by the plaintiffs for the Fall Moon claim, Karangabake.— The defendant contended that the ground applied for was the same as that granted to him by an order of the Warden.—Witnesses named Wm. Dodd and Kelly gave evidence as to the boundaries in dispute* and Mr Eowe, surveyor, substantiated their statements.—Mr Miller appeared for the plaintiffs, and called John Eiley, one the plaintiffs, whose evidence was simply to the effect that other persons had told him where the defendant s pegs were, and how much ground had been pegged out by { him.—The Warden said it was clear that Riley had pegged inside the Victoria claim. 'He would uphold the' objection made by Tregowoth. A nother case connected with the same ground, being an application by William Tregoweth for the Sir Walter Scott claim was decided in favor of the applicant, and Fraser and Riley were' adjudged to pay the costs of the causes.
