RESIDENT MAGISTRATE'S COURT.
,§ THIS DAY. (Before H. Elenrick, Esq., K.M.) FAILING TO SUPPORT. Jas. Simpson was charged with failing to contribute to the support of his wife and children, he being in a position to do so. Defendant did not appear, but Sergt.Major O'Grady put into Court letters proving that he was not ie a position to support his wife, and also a minute statement of his income and expenditure. J. B. Mason deposed that he knew defendant. To his knowledge he had been absent from his wife for the last 7 months, and in consequence she had been receiving nlief from the Borough since Ist April. Witness could not prove that defendant had been in employment. Jane Simpson, wife of defendant, deposed that she had two children, aged 5 and 3 respectively.^ Her husband left her 7 months ago to obtain work. She was not able to support herself without aid from the Borough Council. She had received no money from her husband, though she had written to him and asked him to help her. He said he could not help her. By Mr Mason—When she met defendant in Auckland he did not appear to be hard up. Mr Mason corroborated this evidence. His Worship said he would adjourn the case for a week to enable the .Relieving Officer to communicate with the defendant with reference to sending his wife up to him, and if he then refused to support her, he would make an order. CLARKE V. WHEELAN. Claim, £9 10s 4d, goods supplied. Plaintiff proved the debt, and judgment was given for the amount claimed and COStS; Court adjourned.
