Uttering a Valueless ChequeJames Dillon, alias James Clune, was charged with uttering a valueless cheque for the sum of £17 7s 7d. Sergt-Major O'Grady asked for a remand of the case till Tuesday, which was granted. BREACH OF THE LICENSING ACT. John Eoss was charged with a breach of the Licensing Act, 1873. The evidence in this case was heard yesterday. Mr Miller said he did not intend to offer any evidence as against that produced by the prosecution. He pointed out that the prosecution had failed to show that the place where the offence had been committed was within any licensing district, and if any such course had been attempted it could easily have been shown that the case came within another act altogether. In dealing with clauses of any act carrying penalties it was the custom of law to interpret them in their true meaning. The clause of the Licensing Act referred to three offences — selling the liquor, permitting or suffering the sale—but the prosecution had not shown that the defendant had committed a breach in either of the directions mentioned.

His Worship said thats he could not agree with the views advanced by Mr Miller, and must hold .the offence proved. He would inflict a fine of £20 and costs. Court adjourned.
