RESIDENT MAGISTRATE'S COURT
THIS DAY.
(Before H. C. Lawlbr, and J. Eilgour, Esqs., J.'sP.) ACTION UNDJEB THE SHIPPING AND
seamen's act.
Eoberfc Burr, Captain of the schooner Advance, was charged With refusing to pay Henry Murray for services as mate to the Schooner Advance, the turn of £10 3s Bd, due and owing.
Defendant did not appear. Mr Miller appeared for, And called the plaintiff, whe> deposed that he was recently employed as mate aboard the Advance, now lying at Bagnull's mill. Defendant owed him two months' wages at £6 per month. He received £4« 4s 6d in goods, and by order on account. He had been removed from the vessel by a policeman acting under the captain's orders. He gave no reason for ibis conduct. Sergt.-Major O'Grady said he had just ascertained that the man was drank.
Witness: Mr Miller can prove 4hat I was not. I met him just after the policeman left me. I was quite sober. Mr Miller testified to tha man's sobriety. Judgment for plaintiff for amount claimed and easts, £1 Bs. An order was made for immediate payment. Court adjourned.
