THIS DAY. (Before Colonel Fraser,E.M.) '] BUSPICIOK OF LtTNiCY. James Say was again charged and again remanded, Mr Kenny producing a certificate that he was not yet fit to appear. MAXICIOtTE DAMAGE. Adam Gordon was charged with smashing a pane of glass, value 12 shillings, at the Empire Hotel on tbe morning of the 21st. Defendant pleaded not guilty. Constable Gordon, sworn, deposed—l am stationed at Grahamstown. On the morning of the 21st I saw defendant outside the Empire Hotel, abcut 12.30 midnight, and heard a disturbance. I went over and defendant was lying in the gutter. He said he had been assaulted and thrown out. I saw him throw a stone at the window and heard the glass fall. Defendant ran away, and I followed bim and questioned him. He said he had not thrown the slone. I went into the hotel and McDowell told me the window was broken. By defendant—When you threw the stone I was standing opposite the hotel. John McDowell, sworn, deposed—l resided at the Empire Hotel on March 21st. The bar window was smashed by a stone on the early morning of that day. The damage done was from twelve to fifteen shillings. I am brother of the lessee. I heard angry words between my brother and defendant- shortly before the smashing of the window, and I put him out. I did not strike him on the mouth. Fined 20s and costs, and ordered to pay the damage, or undergo imprisonment for seven days. Court adjourned.
