RESIDENT MAGISTRATE'S COURT

YEStEBDAY. (Before W. Fraser, Esq., 8.M.) CIVIL SIDE. CBIPPEN V. CAMPBELL. The following is the conclusion of our report of the above case, part of which appeared in yesterday's issue :— J. E. Dodd, sworn, deposed—l was present and acted for Mr Crippen when : the rent was paid. I most strongly objected to the costs, but agreed to pay a guinea for him if allowed a month. The plaintiff did not consent to this receipt. He only agreed to pay the guinea. CripFn never agreed to pay the £3., When came to look into it I found it was a downright swindle on your part. H. E. Campbell, sworn, deposed—Some time in March last I received some papers from Mr Brassey connected with this business, and sent a letter. I did not know that Crippen had a lease of the furniture, but thought that what he paid was only rent; or interest, for the money, until possession was taken. I did not know that there was a lease until I was told so in Macdonald's office. Crippen agreed to pay the whole costs, and when it was due 1 urged him to pay it or he might come to some trouble.

By Mr Macdonald—Crippen did not pay the 7 balance of the costs, and I put in

the bailiff. I put him in because the £3 was not paid. Amelia Thornally, sworn, deposed—Mr Crippen had the furniture for 12 months at 5s per week. Mr Campbell addrosed the Court, saying he had no animus, as none of the money came to him. Mr Macdonald replied. His Worship said that Mr Campbell's action was most discreditable, as he bad refused to remove the bailiff when it was shewn him he was , in the wrong. He had never seen such a clear case since he was a Eesident Magistrate. He would give £10 damages, and costs £8. Mr Campbell applied for permission to appeal, which waß granted. Court adjourned.
