RESIDENT MAGISTRATE'S COURT
THIS DAY, ( Before W. Fbaseb, Esq., R.M.)
BEING THE OWNEB OF A VICIOtTS DOG.
Lima Smithwas charged with being the owner of a dog which oh a certain highway, to wit, Coromandel street, Grahamstown, attacked one John R. Smith, whereby the life and limbs of the said John B. Smith were endangered.
Defendant did j&o^put in an appe|ra|ace. Constable Smith was sworn as to serving the summons upon the person. Defendant subsequently appeared and pleaded that she did not own the dog. Mr Bullen said the charge was brought under the 14th section of the Dog Nuisance Act.
John Keogh Smith, Constable, deposed—That he was on duty in Grahamstown on the morning of the 11th. Was in Coromandel street in the afternoon. Defendant resided in Coromandel street, and kept the Prince Alfred Hotel. Whilst near that hotel a dog ran out and bit his trousers. Defendant's daughter, came out, and caught hold of the dog by the collar, else he would have bitten witness again. She said they had not had the dog long. The dog was taken into the house. Two pieces were taken out of his trousers.
Defendant said the dog belonged to Mr Dixon, but sometimes came to her house with the children. His Worship informed defendant that the mere fact of the dog being about the premises was sufficient to constitute the ownership within the" meaning of the Act, and made her responsible. He would impose a fine.of 5s and costs, which would, hot prejudfce the claim of the policeman for the damage done to his trousers, for, which she would have to be responsible.
TRANSFER OF LICENSE, v Robert G. Belters" of ihe Nil Desperandum Hotel, Grahamstown, applied for the transfer of the license held by him to C.F. Quint. There was no opposition from the police, and the necessary papers having been put in the application was granted.
