MAGISTRATE’S COURT.
TIMARU, MAY 16. (Before Mr. E. D. Mosley, S.M.) BY-LAW CASES. P. G. Ellis, charged with exceeding the speed limit, in a motor car, .was hned £2 and cost. H. White, charged wtik driving a motor car on the wrong side of the road, and with exceeding the speed limit,, was fined 20s and costs on the first charge, and £2 and costs on the second. SUPPLYING YOUTH WITH LIQUOR. Henry McL,aughlnn was charged that, being a, person other than the licensee, to wit, the barman ol : tho Empire Hotel, he did supply intoxicating liquor to one Archibald Smith, a personunder the age of 21. Senior Sergeant Fahey said the police had been informed by tho boy’s father that he was being supplied with liquor at the Empire Hotel. Defendant, who was a barman, admitted serving the boy, but said he understood hun to be over 21. Archibald Smith said he had had drinks ,at the Empire Hotel, but outlie day in question the barman had not asked him his age. His father knew he wps in the habit of drinking, as he had been in the bar ,and had seen him “doing so. His Worship asked witness if he knew that he was liable for a fine of £lO for having told the barman he was 21. . Constable Sanvig gave evidence as to having asked the boy his age. The boy had replied stating that he was 21: ' ' •-mm;.. j 'Defendant admitted serving the boy 'with drinks, but took him ,to be over •21. ' Previously to that he.had asked the' ,ftge of the boys-in Smith’s company:. v 1 His Worship said Smith was liable to a charge of having procured liquon while under age. He was satisfied that, defendant might have taken Smith to. be over 21, and would dismiss the charge aganist him. Smith was then charged with procurnig liquor while under the age of 21. _ ; Defendant was convicted and . discharged. ' r ‘ ; A. VAGRANT. ' ; S. Field, ,an old man, appearing on remand, and charged with being an ilde and disorderly pci-son with .no visible’ means of support, was further remanded until Wednesday next, in order that application could be m,ade to the Medical Officer of Health to have him committed to the Old People’s Home.
