SUPREME COURT.

New. Plymouth, Oct. 9,

In the Supreme Court Henry Bailey, aged fifteen, was sentenced to two years' imprisonment for rape on a girl five years old. Oct. 10. At the Supreme Court the jury returned a verdict of not guilty in the charge against Barnard,for breaking and entering, and the charge of stealing from a publichouse was abandoned by the Crown. The jury could not agree in the case of Hunter, charged with rape, and were locked up all nignt. Wanganui, Oct. 6. The Supreme Court resumed .this morning. Caroline Peyman's examination was continued. The • accused wavered somewhat in cross-examination, but her statement Was not broken down.' Emily F. Galbraith and Robert A. Campbell also gave evidence. It was shown by Galbraith that the deceased had no money of her own with which to £ay the £5 with she stated in her deposition she had paid Poyman for_ the operation. In his address to the jury, Mr Hogg, for the defence, dwelt upon the fact of the evident untruth in the declaration as to the £5, and that untruth he contended, invalidated the whole of deceased's statement. Mr Fitzherbert, for the Crown, addressed the jury, relying chiefly on the incompatibility of her conduct. His Honor summed up, if anything slightly against the accused, occupying two and a half hours with his speech. The jury retired at 5.25p.m. and returned at 9.16 p.m. with a verdict of "Not guilty." The prisoner was accordingly discharged. There was a sensation in the court when the verdict was announced.
