Michael Connolly v. Thos. Goodwin—, Claim £7 9s 6d for goods supplied, and balance due for services of the entire. Hanlan.

Mr F. Wilson Smith for defendant, who contended that the goods charged for had been obtained by bis son John, and that the services of the horse bad beenpaid for.

Plaintiff gaye evidence as to his supplying the defendant with goods. Sometimes his wife and at other times his eon came for them. He had received £7 10a on account of the services of the horse, but a balance of £2 10a remained. He bad at the son’s request debited the goods to his account, as the latter said he conld explain the items to the defendant. The goods had, however, always been got for the father by both the wife and son. W. Eeane, a groom in the service of plain iff, deposed to the service-of the three mares. The price was to be £3 each, with a half guarantee £l. Bad strict orders never to take mires fjr less than that.

Defendant-contended that the harness, etc., bad been supplied to his son, John Goodwin, who was away contracting on his own account, and he (defendant) had nothing to do with it. Any goods defendant had got had bean paid for. Mrs Goodwin deposed to paying plaintiff the sum of 18s, which she declared was for all tiie goods got for the defendant. The other items of the account should be charged to the son. She lui made tha arrangement as to the price to be paid for the service of the horse, £7 lOs for three mares, and held that it had been pai '. ■ • Their Worships c nsideiing there was not sufficient proof that the items of saddlery had been procured for the defendant. but that lie was liable for the service of the mares, judgnent would, be for £2 10s, each party to piy their own costs. .
