RESIDENT MAGISTRATE'S COURT.

Temfka—Monday, Oct. 8,1888 [Before John Talbot and James Guild, Esqs., J.P.'s.] DRUNKENNESS. Thomas Simpson was charged with having been drunk while in charge of a horse in Temuka on the inoroing of the 7th instant. The defendant pleaded guilty to the charge and was fiued 4tl and costs. DAMAGE TO PROPERTY. Bobert Blyth and William Dyson were charged with having done iujury to property by pulling down the palings ot a fence belonging to Wm. Storey. Constable Graham said that in consequence of complaints made to the police, he was on duty on the 23rd of last month and saw defendants pull off the palings. Dyson only pulled loff-ODB,- and ,-Blyih —only loosened the naili in one. He would not have 'known who Dyson was only thnt he came to him ('he constible) apd ex- : pressed regret for what he had done, .and offered to repair the fence. Dyson had since repaired the fence. William Ptorey stated that about 5s or 6s worth of damage had been done to the fence, but most of it had been done previous to the occasion on which the defendants were charged. The defendants had come to him and said it had not been done through any ill feeling. They had since repaired the fence, and he wai perfectly satisfied. Mr Talbot said this sort of thing ought to be put a stop to, but seeing they were sorry for what th"y had done and that they had repaired the fence, the Bench would deal leniently with them and fine them only 10s and costs, Ba, each. THROWING- GXAYEL ON A JtOOI. Eobert Winning and William Storey Wire charged with having on the 27th of September thrown stones on the roof of Mr W. 0. Roulston's ■hop. E. Winning said the summons accused him of having committed the offence on the 27th of September, and he was summoned to appear before the Court

on the B>h of September, that is, he was summoned to appear three weeks before the offence was committed. Constable Morton said a clerical error had been mado in the summons by dating it for the Bth of September instead of the Bfch of October. He would ask the correction to be made by the Court. The correction was accordingly made and the case proceeded with. Constable Morton gave evidence to the effect that he was walking down the street about 10 o'clock on the evening in question, and heard a shower of shiogle falling on the verandah of Mr Roulston's shop. On glancing round he saw "two objects moving towards Barr's hotel or shop." They ran in a narrow passage, and he ran after them. Storey went over the picket fence, but Winning waited fur him and told him no harm was done or meant. He knew the causa of it: Mr Boulston kept hia shop open late at night, and the others did not like it.

\V. Storey, jun., said that it did not matter to him, as he was not in the same line. It was not done through any malise wha'soever, but out of fun. W". O. Koulston stated that gravel had been thrown on his roof on the night in question, and on the previous Monday. No damage was done. His shop was not open at the time. It had been closed a long time before that. Mr Talbot hoped that this would be a warning to the defendants, and that they would not do it again. A.» it was evident they intended no harm, the case would-be dismissed, but they would have to pay costs. OIYIL CASES. Velyin and Taylor v. Harold Hansen —Claim 18s 4d. Judgment by default for the amount claimed, and costs. John Angland v. J. Moymhan.— this was an adj -urned judgment summons case. —Mr Hay appeared for the defendant and said the case could not be heard except by the Resulent Magistrate, and after some discussion 't was accordingly adjourned. The Court then rose.
