Wm. Kindley end Harold Godwin were charged with driving furiously on the main road at Geraldine on October 21st.

Defendants pleaded not guilty. "W. Coltman, sworn, said he remembered being in his office on October 21st. Hearing a noise he looked out and saw two sewing-machine vans coming up the rot»d in the direction of Geraldine at a furious pace, A buggy coming in the opposite direction tried to pass between them. The defendant Kindley was driving a one-horse van. Kindley appeared to him to be on the left hand side of the road. The buggy in trying to pass struck Kindley's van and both were capsized, Kindley appeared to be under the influence of liquor. To Kindley : You were galloping your hor3e and nqt trotting it. The other driver was trotting his horses.

James Beckley said he was working close to the scene of the accident on the day in question. He knew the defendants by sight, His attention was called by bis little boy to the two sewingmachine vans coming up the road. Captain Temple'* buggy was coming in the opposite direction and th» horse shied at a scoop lying alongside the road and ran into Kindley's van, Kindley'a van was on the right hand side of the cart. The driver of the b.qggy trjed tq get out of the waj.

K. Temple faH he was coming down the road from Geraldine, driving his father's buggy on Oct. 21st. He saw two vans coming up the road at a furious pace. Kindley's van was on his hit-, hand side and Godwin's on the other. Witness tried to pass between the vans, and Kindley's van struck his buggy on his left-hand side, both vehicles heing capsized, Just before meeting the vans his horse shied at a sooop alongside the road. To Kindley : I am quite sure I did not lose the reins when my horse shied, Thos. Bowkettj wheelwright, said the cost of repairing the buargy was £2 15s, The Bench dismissed the case against Godwin and fined Kindley £l, and ordered him to pay the damages (£2 lhs) and costs of Court (15s).
