JURY’S INDISCRETION.
A NEW TRIAL ORDERED. By Telegraph.—Press Association. Wellington, Last Night. The Chief Justice to-day ordered & new trial in the case of Gallagher versus Bicknell, a claim for £BOO special < damages based on allegeo breaches of ’ covenant to repair buildings, etc., on a leased farm. The jury awarded the £BOO and defendant applied for a new trial on the ground that the damages awarded were excessive, and also that the members of the jury were guilty of misconduct in discussing the case with a witness for the plaintiff at the luncheon adjournment. During th© progress of the case a witness, it was alleged, informed the jurors that defendant made £20,000 out of the in question. The Chief Justice said the information was not actually material to the •case, but it was of such a nature that dt might have affected tho jurymen’s findings.
