MAGISTRATE’S COURT.
JUDGMENT SUMMONS. In the New Plymouth Magistrate’s Court yesterday, Turnbull and Joue«s, of Wellington, proceeded against Harry Patterson on a judgment summons to recover the sum of £9O 5e Bd, being a debt incurred by Patterson and Co., of which the defendant was a member. Mt. R. H. Quilliam appeared for the judgment creditor. There was no appearance of debtor. Counsel said he presumed the firm was solvent, as they were still carrying on business. The judgment summons had been served on Patterson as a member of the firm. His Worship (Mr. A. M. Mowlem) said it seemed a strange position for a firm to allow itself to get into. Counsel said that seven or eight judgment summonses had been taken out against the firm in the last few months, and all had been paid, but those concerned seemed to prefer to allow costs to go on to the debt. They had explained that they were in a good position. His Worship: The Official Assignee had better see whether they are or not if it is not paid. An order was made for the payment of the debt forthwith, in default tyo months’ imprisonment, the warrant to be suspended until fourteen days after the service of the order. Solicitor’s costs £2 2s were allowed.
