DISQUALIFICATION OF ADMIRAL UODRINGTON. Christchurch, Nov. 7. lu the matter of the appeal by F. J. Lysrmr, owner of Admiral Codrington, against the decision of tie Hawke's Bay District Committee in confirming the decision of the committee of the Dannevirke Hunt Club :n disqualifying Admiral Codrington for the Oringi Welter Handicap, run on August 24. owing to the accident fee not having preriously been paid in terms of part 36 of the Rules of Racing, the Conference judges (Sir Geo. Clifford, John Grigg, and Lowry), have delivered the following judgment: The terms of rule 5 of part 36 of the. Rules of Racing, provide -imperatively that no horse si-all he permitted to weigh out for any race unless his name appears in thJ list of horses qualified as notified in the ’official calendar, or there be produced a receipt for the fee payable to the accident fund signed in this case by the secretary of the club holding the race meeting. It is further expressly provided that any horse weighing out in contravention ut this rule shall be disqualified for the race. The judges, therefore, have no option except to confirm the decision of the Dannevirke Hunt Club disqualifying Admiral Codrington. It was alleged in evidence that the accident fee on Admiral Codrington was tendered to rhe secretary of tlie club prior »o races, as one of the items to be included when filling in the sum to be entered in a signed open cheque. Evidence on this point was not conclusive, but in any case no receipt was procured from the secretary of the club, nor produced to the clerk of the scales as required by the rules. Apart from circumstances of this appeal, the judges desire to direct general attention to the danger Involved in the not infrequent negligence of owners in prepayment of accident fees, and of secretaries of ciubs in compelling rigid observance of the rules regulating them. Neglect of this sort may not only lead to disqualifica- : tion of the winning horse, but may deprive an injured jockey of his privilege to apply for compensation after an accident.
