AN APPEAL UPHELD. By Telegraph.—Press Association. Wellington, Nov. 28. The reserved judgment of his Honor Mr. Justice Hosking was delivered in Palmerston North in connection with the appeal case heard in September, in which Thomas Augustus Petheriek appealed against the decision of the Magistrate (Mr. Page) in Dannevirke, in May last. Petheriek had been charged by the police with having wilfully damaged the electrical installation of the Arcadia Picture Company in Dannevirke by severing an electric wire. The Magistrate had entered a conviction and imposed a fine of £,i. The basis of the appeal was that the evidence was not sufficient to warrant a conviction, and his Honor supported this view and allowed the appeal.
