EMPLOYING A RESERVIST.
I AN APPEAR UPHELD. By Telegraph—Press Association. Wellington, Last Night. In the Supreme Court, the appeal of Robert Hannah and Co., boot manufacturers, Wellington, against a conviction for employing a reservist who had not enrolled under the Military Service Act, was allowed. It was admitted at the hearing that Scaifo, the man concerned, was unregistered, but defendants contended that they complied with the Act by taking all reasonable precautions to see that no unenrolled man was employed. Scaife told Hannah and Co. he was a returned soldier, and had misplaced his > certificate of discharge from the forces on account of :nedical unfitness. The magistrate found defendants honestly bo- ' lieved Scaife was eligible for employment, but suggested that the Governnient Statistician should have been communicated with. His Honor, in his judgment, said in his opinion appellants had taken all reasonable steps; accordingly the appeal would bo upheld. As the original action was brought by the police, }>'■ would not allow costs.
