TWO INTERESTING POINTS. Two interesting points were raised by Mr. Spratt, counsel for an appellant, at the sitting of the first Wellington Military Service Board at Hawera. Mr Spratt, asked if a man who had been medical-boarded and classed C2, and who had consequently withdrawn his appeal, would have a further opportunity of appealing in the event of his being called up for home service. The chairman (Mr. I). G. A. Cooper)/ replied that the Military Service Act' provided that in the event of further evidence being disclosed, the appeal could be reinstated. Mr. Spratt then asked whether a man, whose brother had been called up and classed Cll, was still subject to the provisions of Clause 35. Captain Walker said it was perfectly plain that the very fact that a man had been passed for home service, and not classed t>, was the best proof that he was not unfit for military service. A man might not be fit for the atram of trench warfare, and might be quite fit for home service. The chairman read the provisions of the Act which defined military service, and said there was no doubt a C:! man was liable to be called on to do service which was defined bv the Act to be military service. Brothers in the position described would certainly bo subject to .the provisions of Clause 35.
