THE WAIMANA'S EXPERIENCE. By Telegraph.—Press Association. Auckland, Yesterday. The steamer Waitnana, which arrived this morning, had an exciting-experience early in September. When sixty miles off Ushant informatibn was received from a neutral ship that a German submarine was ten miles ahead, the neutral vessel having on board survivors from a British ship sunk bj the submarine. The Waimana zig-zagged and met an English steamer oil-tyden and warned the latter of the proximity of the submarine: A few minutes later shots were heard, .and it was evident that shots were being exchanged between the submarine and the oil ship. The Waimana received the S.O.S. call from the English ship but almost immediately came a second message saying the submarine had gone away. The rest of the Waimana. 's voyage was uneventful. " DEAD MAN'S LIABILITY. Wellington, Yesterday. An unusual point was decided by the Chief Justice (Sir Robert Stout) in the Blenheim case, R, W. Young v. H. S.. Monro. Young brought a claim for ..£IOOO damages for assault. Two days before the date fixed for the hearing Monro paid £175 into court, with a denial of liability. On the day of the hearing Monro committed suicide. Seven days later Young's counsel notified that he would accept the £175 in settlement of the case. The court had now to decide whether ..the money should be paid to plaintiff or to defendant's widow. The judge held that defendant's death abated the action, and that the money must l)e paid to the widow. ; WORE CAM.F VICTIMS Wellington, Last Night. Private Charles Henry .Smith, B Company, 21st Reinforcements, died at Treiithnm Military Hospital this morning from cerebro-spinal meningitis. Private Richard Wearne Sharplin died at the Fcatherston Military Hospital this morning from pneumonia following on measles.
