A SPORTING CASE. (From Our Own Correspondent.) Haivera, Last Night. A case of much interest to the racing world occupied attention at the Magistrate's Court to-day. The parties were Mr. J. Fryer, trainer, as plaintiff, and Messrs J. Gray and J. Cnrran, recent owners of the horse Welcome N'ugget. The plaintiff claimed the sum of £l2O 17s 3d, being certain monies that had been paid under protest in connection with the lease and purchase of the horse mentioned. Mr. Spence, of Stratford, appeared for Fryer, and Mr. Powell (Welsh and McCarthy) for Curran and Gray. It appeared that the defendants leased the horse Welcome Nugget to Fryer on a 15 per cent, basis, with a right of purchase for £lwO. Everything went all right until quite recently, when a dispute arose as to second and third monies, Gray contending that they were entitled to a portion of these also, but Fryer did not agree with this, for the lease, which was drawn up under the Puiles of Racing,, simply stated 15 per cent, of the winnings, and this is defined in the Racing Rules as meaning first only. The crux of the case now depends on the definition of the word "winnings," and the Magistrate ha 3 reserved his decision.
