• Wellington, Last Night. A reserved judgment was delivered by Honor Mr, Justice Sim this afternoon on an application for a stay of proceedings in the Commercial Trusts Act case, the King v . the Merchants' Association The Chief Justice had made an order tor the production of the associations minute book, and the association moved for a stay of proceedings to permit of appeal on the point. Mr. Justice Sim said that the defendants' appeal would be rendered nugatory unless such a stay was granted, while plaintiffs would not be injuriously affected by a stay. His Honor was satisfied that'the appeal was a bona fide one upon a novel point, and the stay asked for should be granted. Costs of £5 5s would be paid by the Merchants' Association in accordance with the usual practice. The application 'by the Sugar Refining Co. for a separate trial was refused by his Honor. The company had failed to prove that there was a possibility of their being injuriously affected by 'having to go on trial with another party. The summons would be dismissed, with £3 3s costs.
The application for particulars in the Sugar Co.'s case was refused, except in so far as the Crown consented. <
